Litigation. Murena & Perez LLC concentrates its litigation practice on complex commercial and business disputes involving fraud, bankruptcy and receivership issues, and real estate. Our attorneys serve as both counselors and advocates for clients. We provide strategic advice and guidance to achieve favorable, cost-effective, pre-litigation resolutions of disputes. Should litigation be necessary, our highly skilled and experienced attorneys will provide effective courtroom and trial advocacy before judges and juries. Members of the firm have represented plaintiffs and defendants in state and federal court in financial transactions and contract disputes, fraudulent transfer actions, bankruptcy-related claims including fraudulent transfer, preference and other avoidance claims, receivership-related actions including asset recovery and constructive trust claims, class actions, legal malpractice actions, and enforcement actions brought by the Securities and Exchange Commission, the Commodities Futures Trade Commission, and the Federal Trade Commission. Among the high profile litigation matters that our Members have worked are the half billion dollar fraudulent transfer claim brought in bankruptcy court arising from the leveraged buyout of International Air Leases, Inc., the class action filed in the Mutual Benefits Corporation federal equity receivership that returned more than $85 million dollars – a 100% recovery – to all members of the class, and the half billion dollar legal malpractice action against one of South Florida's premier law firms that arose from the colapse of Southeast Bank. Appellate Advocacy. In addition to being seasoned litigators and trial lawyers, the attorneys at Murena & Perez LLC are skilled appellate advocates with significant experience representing their clients' interests on appeal. In the event a client faces an adverse ruling or judgment at the trial level, we will provide the appellate advocacy necessary to obtain reversal of that ruling or judgment on appeal. Conversely, should an opposing party appeal a ruling or judgment favorable to a client, we will vigorously defend our client's rights and interests on appeal. The Firm's lead appellate counsel has advocated on behalf of clients, as both appellants and appellees, in numerous appeals taken from state and federal trial courts. Appellate counsel has brought and defended appeals taken to United States Courts of Appeals for the Third and Eleventh Circuits and to the Florida District Courts of Appeal for the Third and Fourth Districts. Among the many clients for which appellate counsel has advocated on appeal are defendants in enforcement actions brought by the Commodities Futures Trade Commission and the Federal Trade Commission in the United States District Court for the Southern District of Florida, the School Board of Miami-Dade County, Florida, a regional airline, and one of the largest insurance carriers in the world. In one appeal, the Firm's appellate counsel successfully defended Air Sunshine and AIG in a federal appeal that set new precedent in the Third Circuit with respect to the issue of multiple occurrences for purposes of insurance coverage in connection with an airplane crash: Flemming v. Air Sunshine, Inc., 311 F.3d 282 (3d Cir. 2002). Bankruptcy and Creditors' Rights. Murena & Perez LLC represents corporate and individual debtors, debtors-in-possession and creditors in Chapter 11 reorganization cases and litigation matters arising out of or related to bankruptcy cases. The Firm also represents third parties with interests in bankruptcy proceedings or assets being administered therein, or involved in bankruptcy-related litigation or other matters. The Firm provides pre- and post-bankruptcy consulting services to corporations and individuals who are considering filing for bankruptcy, who are parties to bankruptcy proceedings, or who otherwise require bankruptcy advice and counseling. Currently, Members of the Firm work on the legal team that represents the Federal Court-appointed Equity Receiver of the Estate of Frederick J. Kunen in the action brought by the Securities and Exchange Commission against the Estate of Mr. Kunen (www.optionstradingfraud.com), who lured primarily inexperienced investors into a risky index options trading scheme with baseless misrepresentations regarding previous and future returns, and either lost their funds trading or converted them for his own personal use. We represent clients in all aspects of their real estate transactions, including contract negotiations, court approval, public and private auctions, title insurance and sale closings. Murena & Perez LLC provides advice and advocacy to individuals and companies seeking to assert or preserve their rights in real property through litigation, including contract disputes and terminations, mortgage defense, refinancing services and foreclosure actions. If you entered into a pre-construction or pre-conversion contract for the purchase of real property, you may have the right to cancel that contract and have your full deposit returned to you. Murena & Perez will assist you in terminating your contract and obtaining a return of your deposit. Further, if you entered into a mortgage with a low teaser rate that has now become unaffordable, you may have claims against your lender and/or mortgage broker, which may entitle you to monetary damages and possibly the right to rescind, or unwind, a mortgage loan. Murena & Perez can assist you in pursuing predatory lending claims. If your current mortgage is unaffordable but there is equity in your home, refinancing, or simply extending the term of your mortgage loan may be a viable option to solve cash flow issues. Modification of your mortgage terms may also be an option, provided your lender is willing to agree to any necessary changes. Either refinancing or modifying your mortgage loan may reduce your monthly payments to a more affordable level.
