Alton C. Todd has tried more personal injury cases to verdict than any other lawyer in Galveston County. He is among fewer than two percent of Texas attorneys who have been Board Certified by the Texas Board of Legal Specialization in both Personal Injury and Civil Trial Law. The Law Firm of Alton C. Growing up on a farm in Hamilton County, Texas, Alton already knew that he wanted to be a lawyer. After graduating from Hamilton High School, he was offered many athletic scholarships but chose to pay his own way through North Texas State University. He worked on a freight dock to support a wife and two children and during summers helped to build swimming pools as a part of a gunite crew. He learned early the value of hard work. After receiving his undergraduate degree in government and education, Alton entered law school at Southern Methodist University. Based on academic achievement, he was invited to be a member of the Southwestern Law Journal, where he was named Texas Survey editor. The prestigious Galveston law firm of Mills, Shirley, McMicken and Eckel marked the entry point of Alton's legal career. While at Mills, Shirley, where he soon made partner, he tried primarily all varieties of insurance defense cases. He then worked for and made partner at the Alvin law firm of Wellborn, Britt and Brown, and, here, he tried numerous cases throughout Texas, the majority in Galveston, Brazoria and Harris counties. Often, he was called upon to represent clients whose cases had been rejected by other lawyers. One such case was Johnson v. Monsanto. With an offer of $0 Alton won that case with a final judgment of over $1 million in favor of Mrs. Johnson. Another memorable case during the time Alton practiced in Alvin involved the death of a child at a day care center. The center's insurance company denied coverage. The maximum insurance coverage was $300,000, but because of State Farm's conduct, the Supreme Court affirmed a judgment that required State Farm to pay over $1 million in favor of the parents. In the business litigation area in the fall of 2004 Alton was co-counsel in a tortuous interference case where a Galveston County jury awarded $20,000,000. Last fall he was co-counsel in an oil royalty dispute representing the geologist who made the find and was denied part of his over-riding royalty a Brazoria County jury awarded $4,500,000. Earlier this year he tried a case against the oldest bank in Texas who failed to timely pay an insurance premium on a life insurance policy that allowed the policy to lapse. The jury awarded full life insurance benefits to the beneficiary and attorneys fees with total damages over $1 million. Recently, in a federal court in Galveston, The Law Firm of Alton C. Todd represented a friend who had been sued for $1,400,000. The firm defended the case and also filed a counter claim. The jury returned a verdict that Alton's client owed nothing but was entitled to damages from the party who sued him in the amount of $1,686,000. Alton C. Todd has tried cases against every major petrochemical plant in the area, including the ammonia spill at Amoco in 1976, the HF acid spill at Monsanto in 1989, Agent Orange manufactured by Dow Chemical and used in Vietnam as a defoliant, the BP explosion in March, 2005 and numerous other plant accidents and explosions. His vast experience in product liability cases has covered scaffolding, volt meters, appliances and automobile stability (Chrysler CJ-5 and 7 and Ford Bronco), seat backs, fuel and seat belt systems. He has represented members of many lawyer families and lawyers, themselves. He has handled many truck accident cases recently recovering over $1,500,000 for a family of a trucker who was accused of running a red light. Through more than three decades of a successful law career, Alton has seen jury attitudes affected by changes in the law and public opinion, but he has consistently maintained excellent communications with juries. In one of his most publicized victories in Galveston County, the jury returned the largest verdict ever rendered against Honda Motor Company in a product liability case. Unfortunately, the Court of Appeals concluded that Alton had persuaded the jury to make a finding that was not supported by evidence. The Court handed him a compliment and a defeat at the same time. The Top 100 Texas Super Lawyers list has included the name of Alton C. Todd since the inception of this award by Texas Monthly. In addition, he was one of the youngest lawyers in the Houston area to have been named to the American Board of Trial Advocates. In 2004, Alton was named by Texas Lawyer as the "Go To" lawyer in personal injury and general civil trial law in Galveston County, and he was recently hired to be attorneys' fee expert in Enron litigation pending in Houston federal court.
