FIRM PROFILE. FRANKLIN, COOPER & MARCUS, PLLC, was formed on January 1, 1998. The firm's members concentrate their practice and are directly involved in the representation of multi-casualty insurers and engage in all types of insurance-related litigation. Each of the four members of the firm has more than 25 years of individual experience in civil litigation in these areas. A fifth attorney, of counsel to the firm, has over 15 years of experience in civil litigation. DAVID L FRANKLIN was born in 1946 and admitted to the Tennessee Bar in 1975. He is a graduate of Belmont University (B.S. 1968) and of the University of Memphis Law School (J.D. 1975) where he was Associate Editor of the Law Review. Mr. Franklin also obtained an LLM Degree in Corporate Law from New York University School of Law in 1976. Mr. Franklin served in the United States Army from 1968-1972. Upon his discharge from the service, he held the rank of First Lieutenant. He is a member of the Tennessee, Chattanooga and American Bar Associates. He also holds memberships in the Tennessee Defense Lawyers Association and the Defense Research Institute. Mr. Franklin has over 30 years of experience in civil litigation. He has tried many jury trials in the Tennessee State courts and in Federal Court and his practice includes the defense of products liability claims, negligence claims of all kinds, construction defect claims, employment liability claims and fire claims, among others. GARY A. COOPER was born in 1947 and admitted to the Tennessee Bar in 1972. He is also admitted to practice in the State of Florida (1980). Mr. Cooper graduated from the University of Tennessee (B.S. 1969) and the University of Tennessee School of Law (J.D. 1972). Mr. Cooper authored Tennessee Forms for Trial Practice (First Edition 1977; Second Edition 1980; Third Edition, 1987; Fourth Edition, 1994; Fifth Edition, 2000) and Tennessee Forms for Trial Practice-Damages (1997 - Present). These books are reference works for attorneys in Tennessee engaged in general trial practice. Mr. Cooper is a member of the Tennessee Defense Lawyers Association and the Defense Research Institute. He holds memberships in the Tennessee, Chattanooga, Florida and American Bar Associations. Mr. Cooper is listed in "Who's Who in American Law" and "Who's Who in Emerging Leaders." He is active in continuing legal education and has lectured at local bar associations seminars on discovery matters. He is a member of the PHI DELTA PHI International Legal Fraternity. He has over 30 years of experience in civil litigation in Tennessee State courts and in the Federal courts in East Tennessee. His practice includes the trial of a variety of negligence actions, products liability, medical malpractice, fire and other first party claims, workers' compensation, construction-related disputes, employment discrimination, and breach of contract actions. H. RICHARD MARCUS was born in 1949 and admitted to the Tennessee Bar in 1974. He was admitted to practice in the State of Georgia in 1975, and he maintains an active Defense Practice in Tennessee and Georgia. Mr. Marcus graduated from University of Georgia (B.B.A. 1971) and Emory University School of Law (J.D. 1974). He is a member of PHI ALPHA DELTA Legal Fraternity. Mr. Marcus holds membership in the State Bar of Georgia and the Tennessee, Chattanooga and American Bar Associations. He is active in continuing legal education programs in Tennessee and Georgia and has been a guest lecturer at workers' compensation seminars at various points across the State of Tennessee. Mr. Marcus is listed in "International Who's Who of Professionals" and has attained an "AV" rating by Martindale Hubbell Law Directory. Mr. Marcus has over 30 years of experience in civil litigation in both Tennessee and Georgia State and Federal courts. His practice includes the defense of negligence actions, first party actions and workers' compensation. DAVID F. HENSLEY was born in 1954 and was admitted to the Tennessee Bar in 1979. He is a graduate of East Tennessee State University (B.S. 1976, Summa Cum Laude ) and of the University of Tennessee School of Law (J.D. 1979). He served as clerk to the Tennessee Court of Appeals, Eastern Division 1979-1980. He has been active in personal injury and insurance defense litigation in excess of 25 years. He was admitted to practice before the United States Supreme Court in 1984. Mr. Hensley is a member of the Tennessee, American and Chattanooga Bar Associations.He also holds memberships in the Tennessee Defense Lawyers Association, the Defense Research Institute and the Chattanooga Trial Lawyers Association. He is a Tennessee Supreme Court 31 listed General Civil Mediator and a Federal Court approved mediator. He has taught nunerous seminars addressing workers' compensation in Tennessee. CYNTHIA D. HALL was born in 1961 in Pell City, Alabama and was admitted to practice in Tennessee and Georgia in 1992. She is a graduate of Auburn University (B.S. 1983) and Georgia State College of Law (J.D. 1992 magna cum laude). Ms. Hall practices in the areas of employment law, commercial litigation, insurance defense and insurance coverage disputes. For many years, she has counseled employers with respect to selection, compensation, discipline and discharge of hourly and management level employees, and has advised businesses on matters relating to risk management, insurance coverage disputes and contract interpretation. She has more than 15 years experience handling negligence and premises liability cases, and has tried many jury trials in Tennessee and Georgia. She has also presented numerous seminars on various employment related topics. Ms. Hall is a member of the American, Tennessee and Georgia Bar Associations. She is currently the President of the Chattanooga Bar Association. She is also involved in civic and community activities. and currently sits on the Board of Directors for The Humane Educational Society. Inc, and Signal Centers, Inc. The firm employs three full-time paralegals, CHARLOTTE WRIGHT, KATHRYN CASEY, and MEREDITH MOREHEAD. CLIENTELE. The following representative clients are regularly involved in assigning litigation to this firm for defense: Allstate Insurance Company; TIG; Prudential Property & Casualty Insurance Company; The Harford Mutual Insurance Company; Argonaut Insurance Company; Travelers Property & Casualty Insurance Company; Harleysville Mutual Insurance Company; Cotton States Insurance Company; GEICO Insurance Company; Memorial Hospital of Chattanooga; Tennessee Municipal League Risk Management Pool and Anesthesiologists Professional Assurance Company. The firm also represents other clients who are either self-insured or through referrals from national adjusting firms who are not customarily listed among clientele in published legal directories or firm resumes. Specific references within the insurance industry, as well as references among adjusting companies, risk management departments or companies, and self-insured clients, will be furnished upon request. PRACTICE. The firm's defense practice handles workers' compensation, general tort (including automobile, product liability, public liability, premises liability, professional liability, employment liability, and other general liabllity claims) fire, inland marine, insurance coverage questions, public entity defense, civil rights, contract disputes, employee relations and environmental issues. No member of associate of the firm has sought certification or specialization in any area of the law under any state certification program. The firm endeavors to keep its regular clients informed of significant changes in the law. In addition. from-time-to-time, members of the firm conduct training seminars for the staff of its clients at the clients' request and lead law-related seminars. Geographically, members of the firm practice in Tennessee from approximately halfway to Nashville to the west and to Knoxville to the north, though members do have some cases in other major cities in the State. The firm's Georgia defense practice is concentrated in the northwest counties of Georgia.
