Cindy Hutchins is a cum laude graduate of Northwestern University School of Law. For the past 15 years she has focused the practice on issues involving Elder Law, Probate, Wills, Trusts and Guardianships. Cindy is a frequent invited presenter and author providing education and training for other attorneys surrounding Elder Law, Trusts, Wills, Guardianship and Probate issues. Cindy's practice has grown significantly over the past 15 years due to referrals from my existing clients, other attorneys and word of mouth. Wills: I carefully discuss a client's intentions to properly advise and prepare a Will meeting the client's needs. During our initial conference with a client we will review with the client all relevant factors to properly craft the Will. I deal extensively and compassionately with special situations (minor beneficiaries, beneficiaries with disabilities, special assets, excluded family members, planning for future generations, second marriages) to accurately reflect the necessary will provisions. I discuss the tax implications of a client's situation. Additionally, I will assist the client with a review of beneficiary designation forms for insurance and retirement plans to ensure that they accurately mesh with the client's estate planning objectives. Estate Tax Planning. I review a client's financial situation to determine appropriate tax planning opportunities and ensure accurate handling of assets and beneficiary designation forms. If appropriate, estate tax planning provisions are carefully included in a client's estate tax planning documents. TRUSTS. Drafting of Trusts. I assist clients with crafting single trusts, joint trusts, charitable trusts, minors trusts, special needs trusts, OBRA Payback Trusts, and trusts incorporating estate tax planning provisions. I discuss with clients on all aspects of the preparation of such trusts. I consider it very important for each client to understand all of the provisions of each trust. I review those provisions with each client to ensure the trust accurately reflects the client's intentions. I carefully consider the planning opportunities available for each client. Finally and most importantly, I work with each client to properly fund the trust. Trust Administration. I help trustees understand the trust document and the trustee's role in administering the trust, including tax issues, investment responsibilities, distribution schemes, liability and ongoing administration and accounting duties. Advise beneficiaries in ascertaining their interests in a trust and assist such beneficiaries in obtaining their proper distributions. Trust Litigation. I participate in trust litigation and construction lawsuits. My office assists trustees or beneficiaries in such contested matters, with communication, settlement negotiations, discovery and hearings on such matters. We will work with the client to appropriately petition the Court for determinations on trust interpretation issues. ELDER LAW. Medicaid Eligibility Issues. I counsel clients in the specifics of Medicaid eligibility issues. We carefully review a client's financial situation and determine appropriate planning methods based upon those resources and the client's needs. I explain the rules applicable to planning for spouses living in the community and the impact upon the eligibility for benefits of the nursing home spouse. I determine other planning opportunities which may be of assistance. These planning opportunities may include the setting up of specific types of trusts and the transfer of assets permissible under the current Medicaid rules. Medicaid Application Process. I assist clients with understanding the documentation necessary for the proper application for public aid benefits. Additionally, my office provides assistance with the preparation of Medicaid applications. Long-Term Care Financing. I assist clients in gaining an understanding of the issues surrounding long-term care financing. These include discussions covering long-term care insurance and review of long-term care placement contracts. Special Needs Trusts. Certain clients may benefit from the preparation of certain types of types to benefit individuals with disabilities. These include Special Needs Trusts, Third Party Special Needs Trusts, Payback Trusts and OBRA Pooled Trusts. I attempt to carefully match a client with the appropriate type of trust planning. PROBATE. Representing Executors and Administrators in Probate Administration. I attempt to compassionately and conscientiously assist clients with the probate process. We represent Executors and Administrators in the process of obtaining appointment by the Court. My office will prepare necessary paperwork, appear at Court hearings and prepare necessary notices to accurately petition the Court for the admission of the Estate to Probate and for the appointment of the legal representative. I assist clients with understanding the on-going role, duties and responsibilities of an Executor or Administrator, including issues surrounding will interpretation, distributions, claims, beneficiaries, liability and investment obligations. We work with clients to administer the probate estate as promptly as the law allows. Assisting Beneficiaries. We assist beneficiaries of Estates by carefully explaining their rights in the probate process. We counsel beneficiaries to assist them in understanding the provisions of a Will. I attempt to effectively negotiate on the client's behalf to ensure that the client realizes the full extent of their beneficial interest in an Estate. Contested Probate Estates. I work to effectively represent parties in contested estate situations. In the past I have been involved with numerous contested estate situations, including will contests, will interpretation/construction litigation, removal of executors or administrators, accounting litigation, contested distribution issues and fabricated document litigation. I have participated in the successful appeal of probate issues. GUARDIANSHIP. Guardianship Administration. I assist individuals with petitioning the Court to obtain guardianship over a disabled individual or minor. I meet with clients and then prepare the necessary paperwork and attend Court appearances to accurately petition the Court for a determination of disability and appointment of guardian. We work with a client to carefully craft the parameters of a limited guardianship, if appropriate. Once clients are appointed as Guardians, we assist clients with understanding the role of guardian. I frequently help Guardians with the preparation and presentation of annual Court reports and accounts required of Guardians. Additionally, I also assist individuals who are contesting a guardianship or involved with conflicts within a guardianship proceeding. POWERS OF ATTORNEY. Financial Powers of Attorney. I discuss with clients the advisability, limitations and liabilities concerning financial powers of attorney. Additionally, I assist clients with the creation of Power of Attorney documents and properly tailoring the statutory forms to meet the specific intentions of the clients. I counsel clients who are acting as agents in understanding their fiduciary duties. Health Care Powers of Attorney and Living Wills. I assist clients with the preparation and review of these forms to assist clients in understanding the important alternative provisions in these health care directives. My office has also helped clients prepare Disposition of Remains forms and Designation of Mental Health Care Preference forms. ESTATE TAX RETURN PREPARATION. Estate Tax Returns. I assist with the preparation of Illinois and U.S. Estate Tax Returns. I work with clients to obtain accurate valuations for such returns.
