Firm History. Shell, Fleming, Davis & Menge, P.A. began as Shell & Davis, when Rollin D. Davis, Jr. and Thurston A. Shell opened their law office together shortly after completing law school in June of 1956. In August of 1956, Mr. Davis entered the army as a member of the Judge Advocate General's Corps. In 1957, Mr. Shell and Fletcher Fleming formed a partnership, Shell & Fleming, and in 1959, Rollin Davis returned from the service as a member of the Firm Shell, Fleming & Davis, with offices in the Brent Annex Building. In 1963, the Firm moved its offices to The First Bank & Trust Company Building, now Barnett Bank Building, and in 1965, M. J. Menge joined the Firm, becoming a partner in 1968, when the Firm's name was permanently changed to Shell, Fleming, Davis & Menge. In 1973, the Firm took offices in the historic but newly renovated and renamed Seville Tower, formerly the Florida National Bank Building, and prior to that, the American National Bank Building. The building, which is owned by several of the Firm's partners, remains a landmark in downtown Pensacola and a credit to the community. The Firm renovated and moved to the top four floors of the building in 1996. Over the years, the original partners have thoughtfully and carefully added additional lawyers to the Firm, structuring our growth to accommodate the legal needs of our clients and the community. The growth of the Firm has been slow and deliberate, in a careful effort to assemble a group of lawyers and staff who work together well, enjoy and respect each other, are highly motivated toward legal and moral excellence and client service, and thus are best able to serve our clients and the honor of our profession. Shell, Fleming, Davis & Menge has developed an active practice in the representation of community associations, including homeowner and condominium associations, working closely with association management and boards of directors in the enforcement of covenants and restrictions, collection of delinquent assessments, resolution of disputes with developers, owners and tenants, transition of the association from developer to owner control, amendment of association documents, and counseling the association in the day-to-day operation and management of the property. Construction Law. The Firm represents owners, contractors, suppliers, design professionals and developers in the complex field of construction law, including counseling in all phases of construction projects, from the initial contract through the administration of the project to litigation if necessary. Included in this area is representation relating to construction liens, claims for defective work, claims for delay, and other types of claims for damages or equitable relief, in both residential and commercial settings. Corporate, Banking and Business Law. Shell, Fleming, Davis & Menge has long emphasized and enjoyed an excellent reputation in the areas of corporate, banking and business law, representing a wide variety of small businesses, major corporations, banks, credit unions, and savings & loan associations. In 1988, in order to meet the overall legal needs of the community, the Firm concluded that it needed to expand its services to include a specialty in the field of criminal law. The Firm has an impressive array of experience in the criminal law field, having added attorneys with extensive criminal trial experience. Our attorneys represent and protect the rights of the accused in County, State and Federal Courts, as well as before administrative agencies. These services range from representing individuals in local traffic court to providing comprehensive defense for those under investigation or prosecution for violations of complex state and federal statutes, including DUI's, violation of probations and the growing area of "white collar" crime. In this unique and extremely sensitive area of the law, our attorneys are responsive, available, discreet and committed to efficient and professional representation. Estate Planning, Probate and Trusts. Included in this area are Federal and State tort claims and insurance coverage disputes. In cases involving the representation of injured persons or companies, the Firm accepts cases on a contingency fee basis in which fees are payable only upon recovery for the client. Shell, Fleming, Davis & Menge also has a long history of expertise in the representation of insurance companies and self-insured businesses in the defense of personal injury and wrongful death claims. We have also had a special emphasis on the defense of medical malpractice claims, representing physicians, hospitals and other health care providers. Real Property Law. Shell, Fleming, Davis & Menge has for many years had a strong concentration in all areas of real estate law. Clients in these areas include individual and institutional owners and investors, commercial and residential developers (including condominiums and subdivisions), and state and national lending institutions. The Firm serves as counsel to real estate developers in every type of real estate project from beginning to end. The work includes guidance in structuring the development entity, including corporations, joint ventures, partnerships, limited liability companies, and trusts; assistance in planning the project; contracting for and obtaining the project site; representation in obtaining zoning and governmental permits, including Developments of Regional Impact; advising regarding comprehensive plans and concurrency requirements; arranging and closing acquisition, construction and permanent financing; negotiating construction contracts; and advising the developer with respect to environmental concerns. When the project has been completed, the Firm is able to handle expertly the sale or lease of the finished product. The Firm also handles the preparation of condominium and community association documents and registration with governmental authorities. Our real property attorneys are experienced in the examination of title to real property and the resolution of title issues. The Firm is an agent for several major title insurance companies, and can provide title insurance and closing services for all types of residential and commercial properties, and for buyers and lenders.
