Sullan2, Sandgrund, Smith & Perczak, P.C., is located in downtown Denver, Colorado. The firm focuses on construction litigation with an emphasis in construction defects and material defects and related insurance coverage issues. Sullan2, Sandgrund, Smith & Perczak, P.C. was one of the first law firms willing to take on the Colorado home construction and development industry in the early 1990s. Today the firm is one of the leading construction defect litigation law firms in the state, whose cases and attorneys are regularly in the news each year. The firm represents homeowner associations and individual home, condominium and townhome owners in the Denver Metro area and on Colorado's Front Range, in the High Country and along the Western Slope in construction disputes ranging from soil and slope instability and other geologic hazards, to poor workmanship, to defective building envelopes (siding, stucco, EIFS, windows and roofs) and other construction defects, to failing private roads and infrastructure, to construction material and building product failures, and including insurance disputes and serious personal injury. Firm principal Scott Sullan is the regular subject of media profiles speaking out on behalf of and representing Colorado's homeowners. A leading Colorado newspaper described Mr. Sullan as "one of those truly ethical and fair-minded attorneys who bring honor to an often maligned profession," and "a nationally-prominent litigator who is the scourge of the homebuilding industry". Another Denver paper headlined Mr. Sullan as: "The Legal Bane of Homebuilders.". A Denver newspaper has observed: "Some builders settled quickly after watching Sullan at work in 1996. During the trial, officials with Richmond Homes told Sullan they wanted to settle a separate class-action case he had filed on behalf of 12,300 Richmond homeowners. He tried Mission Viejo by day and negotiated with Richmond by night. In June 1996, Richmond agreed to pay Sullan's firm $1.9 million and to spend tens of millions more to remedy problems.". The firm's hard work led to the following news headlines in 2005:. "Builder Okays $39 Million End to Suit: largest settlement of construction defects lawsuit in Colorado history.". "Lawsuit Over Defects in Condos Resolved: D.R. Horton, the Texas-based home-building titan, has paid a record $39.5 million settlement to resolve a defective-construction lawsuit brought by condo owners.". "Firms Will Pay $32 Million to Settle Suit Over Windows". Since 2005, the firm has obtained $25 million and $18 million settlements, among others, for Colorado homeowner associations. Firm principal Ron Sandgrund is the state's most prolific author of articles and books on Colorado construction and materials defect law, and related insurance coverage issues. Mr. Sandgrund files friend of the court briefs expressing the views of homeowner-advocacy groups, and his writings have been referred to in court opinions. Firm principal Joseph Smith brings his experience as a licensed architect to every case. Firm principals Scott Sullan and Ron Sandgrund are co-authors of the only books devoted to residential construction defect disputes in Colorado: Residential Construction Law in Colorado, published in 2005 (an updated, second edition is expected to issue by the end of 2007); and, Residential Construction Defect Litigation, published in 2000. The firm's attorneys have authored more articles on Colorado home defect laws and lawsuits than any other law firm in the state, and their work has been referred to in court opinions. The firm also has extensive experience in other civil trial practice areas including insurance coverage and bad faith claims handling practices, serious personal injury and wrongful death, property damage, and product liability. The firm has represented many homeowner associations and thousands of Colorado homeowners seeking damages for construction and material defects in single-family homes and multi-family developments, as well as in infrastructure, such as community roads. In 1996, the firm tried and obtained a verdict in a class action lawsuit in favor of over 1,600 homeowners against one of Denver's major residential real estate developers. Since 2004, the firm has concluded $39.5 million, $25 million and $18 million settlements arising from construction defects in multi-family developments (among others), as well as a $32.5 million settlement in a defective and leaking windows case. Since The firm has successfully resolved many other suits against major developers, home builders and product suppliers. Construction litigation requires knowledge and experience in dealing with many trades, businesses, consultants, expert witnesses and professions, including architects, engineers, developers, builders, contractors, governmental agencies, insurance companies, bonding companies, and others. The firm has extensive knowledge and experience dealing with all of these in both litigation and alternative dispute resolution settings. The firm handles and encourages all forms of alternative dispute resolution in the construction arena, including arbitration and mediation. The firm also has a well-established appeals practice in both the state and federal courts.
