Execution of police officer's killer delayed 07/14/2009 By MICHAEL GRACZYK �/�Associated Press A state judge has moved this week's scheduled execution of condemned murderer Kenneth Mosley to September, his attorney said Tuesday.

Mosley, 50, was set to die by lethal injection Thursday for the fatal shooting of Garland police officer Michael Moore.

The 32-year-old officer was fatally wounded during a bank robbery 12 years ago by a bullet that struck above the top edge of his protective vest.

Mosley was shot in the wrist by another officer waiting outside the bank and was arrested in the parking lot.

Defense attorney Bruce Anton said Mosley's execution is now scheduled for Sept.


Mosley still has unresolved appeals pending before the U.S.

Supreme Court and his attorneys requested the delay.

At the time of his arrest, Mosley was wanted in the Dallas area for holding up a fast-food restaurant where he once worked.

When he walked into the Garland bank, an employee recognized him as the man who robbed the same bank more than a month earlier.

Moore was among officers to respond to a 911 call.

When he approached Mosley, who was waiting in line, the two men struggled and fell through a window.

Mosley pulled a 9 mm pistol and opened fire.

At his trial, Mosley's lawyers argued the shooting was accidental.

They said Mosley was trying to surrender the weapon when it went off five times, with four of the shots hitting Moore.

A witness testified that she saw Mosley stand over the fallen officer and continue shooting.

Another execution is set for next week in Texas.

Roderick Newton faces lethal injection July 23 for the slaying of 20-year-old Jesus Montoya, who was carjacked and then shot as he was forced to make a withdrawal from an ATM in Dallas 10 years ago.
